INTRODUCTION:

This Privacy Policy contains the manner in which Evnnovator Technology Private Limited (Evnnovator) shall collect, store and use the information: a) shared by the User with Evnnovator while signing up to use the App; and b) collected by Evnnovator in the process of the User using the Services in the App/ Website.

(All terms that are capitalized shall have the meaning and definitions as defined under the Terms& Conditions of using the App which can be accessed at https://evnnovator.in/terms-and-conditions/ .

This Privacy Policy (the “Policy”) shall become effective on the date the User agrees to be bound by the Terms and creates an Account on the App (irrespective of whether the User may use the Services thereafter or not). Merely signing up to the App and creating an Account will be deemed to be an express agreement to the Terms and this Policy.

Evnnovator collects certain personal information of the User at the time of creating an Account in the App. In addition to the above, Evnnovator also collects certain (non-personal) information when the User avails certain Services under the App. This Privacy Policy that is part of the Terms details out the information collected and stored by Evnnovator along with the manner in which the said information will be used by Evnnovator.

We wish to clarify and stress that any information sought by us and/or collected by us will only be used in accordance with this Policy. Evnnovator further endeavours to protect the interests and privacy of all Users and has taken suitable security measures to protect information submitted by the Users.

Evnnovator may change the terms of this Policy from time to time and the latest updated Policy can be found on the App and Website under the heading ‘Privacy Policy’.

1. INFORMATION COLLECTED BY EVNNOVATOR:

1. INFORMATION PROVIDED BY THE USER:
   
   Evnnovator may collect the following information from the User at the time of signing up to avail the Services or thereafter:

1. Personal Information: We collect certain personal information at the time of the User registering himself on the App and creating an Account. This information includes and is not limited to name, date of birth, Driving License Registration, phone number, address, email ID, designation, organisation of employment;
2. Electric Vehicle Information: EV type, make, model, Chassis Number, Vehicle Identification Number, Battery Type/ size, connector details, EV Registration Number, Proof of Ownership of EV;
3. Account Information: Information pertaining to the creation of the Account including user ID, password, details of security questions to access the Account;
4. Financial Information: credit card/ debit card details, payment wallet user ID and passwords, payment instruction details and other information to enable the seamless completion of a transaction or payment for the Services.

Evnnovator states that it shall make no back up of any information provided to it (except for business continuity purposes and as may be required under any applicable laws) and the User shall be solely responsible to maintain copies of any information provided by the User to Evnnovator. Evnnovator may however assist the User in retrieving certain information if so requested by the User. The User further agrees to maintain back ups of all information provided  to Evnnovator in the event of the any downtime/ malfunctioning of the App and shall (re)submit the same to Evnnovator as and when requested.

2. INFORMATION COLLECTED BY EVNNOVATOR FROM THE APP:
   
   Evnnovator also collects the following information during the course of the User availing the Services on the App:

1. Log Information: Technical log information such as your IP address, browser type, location of the phone, location of the EV, language, dates and times of visits and other requests while using the App, details of favourite CPOs,;
2. Account Transaction History:  All information pertaining to the activity on the App, Services availed, payments made, details of any refunds, service requests, service requests cancelled/ modified
3. Navigation Information: Information about the pages you visit when availing of the Services on the App;
4. Geographical Location: Postcode, preferred EV locations, favourites, home/ office locations, live location of the EV, live location of the User and any other favourites/ interests as saved or used on the App.
5. Charging Information: Location of every charge and other Service availed under the App; battery status, electricity consumed per charge; charge time; vehicle idle time after completion of charge at the CPO location; information provided and stored by the Equipment; and other related analytical information pertaining to the battery and EV collected while availing the charging Services;
6. Other information: Relevant to customer surveys and/or offers.

Evnnovator reserves its rights to cease the provision of Services or access to the App; or terminate the Services as it may seem fit in the event that the User fails to provide any information or documentary proof of certain documents that Evnnovator requires. Evnnovator further reserves the right to refuse registration or open an Account under the User Agreement till such time that the information required is provided to the satisfaction of Evnnovator.

2. USE OF THE INFORMATION COLLECTED BY EVNNOVATOR:

All non-public information provided to Evnnovator shall be used to help provide the Services, improve the App and the quality of Services provided to the Users.

The information shared with and collected by Evnnovator may be used for the following purposes:

• To provide the Services agreed to under the T&C;
• To improve the quality of Services;
• To process payments for Services or other dues, where applicable;
• To provide customer support;
• To ensure that the Users adhere to the Terms;
• Internal record keeping;
• To regulate and manage our relationship with you;
• Analyse the App, CPO Equipment usage and EV Status during utilisation of the Services;
• Analyse EV and battery information to enhance the Services;
• To identify any problems that the CPO and Equipment may bring about since different EV types, connectors etc are used in the Equipment;
• To ensure that necessary safety features can be incorporated by the CPOs in the Equipment and so that suitable alerts can also be issued by the App;
• To identify closest CPOS and Equipment and provide status of any available CPO Locations;
• To comply with the applicable laws or requirements;
• Send promotional emails about new Products/ Services, offers or other information to the email address and contact information provided;
• issue banners and alerts on the apps to provide updates on Services;
• Market research purposes;
• We may use your personal information if you may so desire to share promotional information and third party information that you may find interesting based on your interests and locations;
• We collect and use data and analyse the same to produce analyses for marketing, strategy and other business purposes. Use and results of any non-public information and results/analyses shall be the property of Evnnovator and you will not be entitled to any compensation for such use thereof.
• It is further clarified that while Evnnovator collects certain metrics pertaining to the EV and other personal details while creating the Account, please be assured that no personal information in any form shall be shared with any third party (eg., name, personal details, EV registration numbers, etc., shall not be shared under any circumstances whatsoever).

The User agrees that you have no objection to the above.

3. SECURITY:

Evnnovator has in place suitable physical, technical and electronic safeguards to secure the information we collect online.

All financial information pertaining to the payment details, card details, payment wallet login information, transaction details etc., upon the completion of an individual transaction is stored for a certain period for business continuity purposes and as may be required under applicable laws. Evnnovator shall however continue to ensure maximum safety and security of all such information stored.

Evnnovator shall not be responsible for any data theft or any other unauthorized access or use of such information.

4. CONTROL OF INFORMATION BEING SHARED & COLLECTED:

The User will be given the option to agree to receive information, communications, marketing and promotional offers and can make an appropriate choice if it does not wish to.

Any subsequent changes that need to be made to any choices made previously with regard to receiving any information and/or sharing any information can be done subsequently by way of writing to Evnnovator at info@evnnovator.in

Any decision to stop sharing certain information/ desire to withdraw consent towards the provision of any information may be done by the User subject to:

• Providing the withdrawal of consent in writing by letter, or by e-mail with an electronic signature, addressed to info@evnnovator.in
• Such withdrawal of consent, will entail Evnnovator to restrict or stop the Services or access to the App/Website without prejudice to its other rights.
• Such withdrawal of consent shall take effect only from the date on which such communication in writing reaches us (“Withdrawal Effective Date”).
• Such withdrawal of consent shall not affect any actions already taken by Evnnovator in accordance with this Policy until the Withdrawal Effective Date.
• In this regard, the User acknowledges that Evnnovator will need a reasonable time of 60 days to delete the information given by you from our records and to ensure that the same is not used further.

Continued use of our services after such changes have been published to our services will constitute your acceptance of such revised policy.
